New York City's Divison of Consumer Affairs is taking the position that if cell phone companies advertise that a minute is free, it should be -- you guessed it -- free.
"You can't promise a great deal in the headline and hide the true costs in the fine print," said DCA Acting Commissioner Jonathan Mintz.
The lawsuit seeks maximum fines against Nextel, Sprint and T-Mobile. Texas and California made similar arguments in an FCC filing last month.
Doesn't seem all that controversial, does it?
